General terms and conditions for using the Hundswerk online shop  

 § 1 scope 

 

(1) The following "General Terms and Conditions" (GTC) apply in the version valid on the day of the order for all purchase contracts for products on www.hundswerk.at and www.hundswerk.com between the Hundswerk online shop and a consumer / customer in the version valid at the time of the order. By placing an order, the customer agrees to these terms and conditions and is bound by them. 

 

(2) Should individual provisions of these GTC be wholly or partially invalid due to mandatory statutory provisions (in particular the provisions of the KSchG), the remaining provisions of these GTC shall remain effective.

 

(3) The inclusion of own conditions by the customer / contractual partner is contradicted, except in the case of the consent agreed before the purchase contract. 

 

§ 2 Conclusion of contract 

 

All offers from the Hundswerk shop (web shop) are non-binding and should be understood as an invitation to the customer to make an offer himself. The contract is concluded when the Hundswerk shop accepts the order, namely by sending an order confirmation electronically or directly by sending the ordered goods. 

 

§ 3 Right of withdrawal 

 

There is no right of withdrawal for items ordered in the Hundswerk online shop. According to § 18 FAGG, this applies to goods that have been made to customer specifications and/or are tailored to the personal needs of the customer. 

 

§ 4 Prices 

 

(1) In principle, the purchase price for the ordered goods is deemed to be agreed, which can be seen in the current prices in the online shop (errors excepted). 

 

(2) All prices stated on the Hundswerk website do not include shipping costs. These are listed separately in the shopping cart. 

 

 § 5 Terms of Delivery 

 

(1) Delivery normally takes place within 15 working days of receipt of the order via the Hundswerk online shop. If materials are not available, this will be communicated to the customer immediately and the customer will be informed of a delayed delivery date. 

 

(2) The postage/shipping costs amount to a flat rate of €7.50 per delivery for deliveries within Austria from February 1st, 2021. For deliveries within the European Union, shipping costs will be communicated on request. 

 

(3) Shipping is carried out with a shipping company selected by Hundswerk and cannot be specified by the buyer. 

 

§ 6 Terms of payment 

 

(1) The available payment methods can be seen in the online shop when the order is completed. 

 

(2) Unless otherwise agreed, the total amount is due immediately after the order if you choose "payment in advance". We reserve the right to cancel your order after a period of 4 weeks if payment is not received and to withdraw from the contract. 

 

§ 7 Warranty, Liability and Damages 

 

(1) Hundswerk products are conscientiously handcrafted by us. No liability or warranty is assumed for damage caused by the dog or dog owner during use (strong pulling and subsequent material damage, detachment from the collar, biting the leash or collar, etc., as well as negligent use by the dog owner). The customer cannot make any claims for damages as a result of the above-mentioned damage. 

 

(2) Damage to the processing and the material must be reported to us by the customer immediately after receipt of the goods. The goods can be returned to us; the customer bears the costs for the return shipment. After checking the existing damage and if it already existed when Hundswerk shipped it, the product will be replaced or repaired. 

 

(3) Hundswerk assumes no warranty / no exchange for length / size errors, which are caused by incorrect measurements by the customer. We manufacture all products according to customer specifications / dimensions as precisely as possible. Since it is handmade, we allow for a size tolerance of +/- 1cm during production. 

 

(4) In addition, the statutory warranty regulations apply to damages that exist at the time of delivery / handover. 

 

§ 8 data protection 

 

Customer data that is made available to Hundswerk in the course of concluding the contract can be stored and processed for accounting and customer records purposes. The data is used to comply with legal regulations and to process payment transactions. Customer data will not be passed on to third parties unless this is absolutely necessary for the execution of the contract. 

 

§ 9 Place of jurisdiction and applicable law 

 

(1) Austrian substantive law shall apply to this contract, excluding the UN sales law. 

Place of performance of the contract / place of jurisdiction is Vienna. 

 

(2) The competent court in Vienna has exclusive jurisdiction for disputes. 

 

§ 10 Right of retention, retention of title 

 

(1) The goods remain our property until the purchase price has been paid in full. 

 

§11 Contract language 

 

(1) German is specified as the contract language.
